Terms of Use
These Terms of Use govern your access to and use of the Nelo application ("App"), operated by Ivan Borisov ("we", "us", or "our"). By downloading or using the App, you agree to these terms. If you do not agree, do not use the App.
1. What Nelo Is
Nelo is a thought evolution system. It helps you submit unresolved thoughts, engage with AI-generated questions, receive snapshots and insights, and revisit your thinking over time to observe how it evolves. Nelo is not a mental health service.
Nelo is not a substitute for professional psychological, psychiatric, or medical advice. If you are experiencing a mental health crisis or require professional support, contact a qualified healthcare provider or emergency services in your region.
2. Eligibility
You must be at least 13 years old to use the App. By using Nelo, you confirm that you meet this requirement. If you are under 18, you represent that you have obtained parental or guardian consent.
3. Account
You must create an account using Sign in with Apple or Google Sign-In to use Nelo. You are responsible for maintaining the security of your account. Each person may have only one account. You may not share your account with others or create accounts on behalf of third parties.
4. Your Content
You retain ownership of the thoughts, answers, interim notes, reflections, and other content you submit ("Your Content"). By submitting Your Content, you grant us a limited, non-exclusive licence to host, store, reproduce, and process it only as needed to provide, maintain, and secure the App, including transmitting relevant context to our AI provider to generate App features.
You are responsible for Your Content. Do not submit content that is unlawful, infringes another person's rights, is harmful to others, or that you do not have the right to share.
5. AI-Generated Content
Nelo uses AI models provided by OpenAI to generate questions, snapshots, insights, comparisons, summaries, and thinking pattern analyses. This content is generated automatically and may be inaccurate, incomplete, or unsuitable for your situation.
AI-generated content is intended only to support personal reflection. It is not psychological, psychiatric, medical, legal, financial, or other professional advice, and you should not rely on it as such.
6. Prohibited Use
You agree not to:
- Use the App for any unlawful purpose or in violation of any applicable laws or regulations.
- Attempt to gain unauthorised access to other users' data or our backend systems.
- Reverse engineer, decompile, or attempt to extract the source code of the App.
- Use automated tools to scrape, copy, or extract content from the App.
- Misuse the App in a way that could damage, disable, or impair its functionality.
- Submit content designed to manipulate, deceive, or exploit the AI systems.
7. Subscription
Nelo offers a free tier and an optional paid subscription called Nelo Unlimited. The free tier lets you create up to three new threads. Each thread created while you are using the free tier includes two further AI-guided returns. A thread created while Nelo Unlimited is active does not gain free returns if the subscription later ends. Nelo Unlimited lets you create unlimited new threads and continue eligible threads while the subscription is active. Any additional benefits are shown in the App before purchase.
Without an active subscription, you may create threads until the three-thread allowance is used and continue a free-tier thread while it still has an included return. Starting another thread or continuing beyond the applicable allowance requires Nelo Unlimited. Content you already created remains available to read and export.
Subscriptions are purchased through the Apple App Store, charged to your Apple ID, and renew automatically unless cancelled at least 24 hours before the end of the current billing period. Pricing and subscription length are shown before purchase. You can manage or cancel a subscription in your device Settings → Apple ID → Subscriptions. Refunds are handled by Apple under its policies. Deleting your Nelo account does not cancel your App Store subscription.
8. Intellectual Property
Except for Your Content and third-party materials, the App's software, product design, AI prompt systems, interface elements, and Nelo brand are owned by Ivan Borisov and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from them except as permitted by law or with our prior written consent.
9. Disclaimers
The App is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the App will be uninterrupted, error-free, or that AI-generated content will be accurate or suitable for your needs.
We are not responsible for any decisions you make based on content generated by the App.
10. Limitation of Liability
To the fullest extent permitted by applicable law, Ivan Borisov shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including loss of data or emotional distress. Our total liability to you for any claims arising from these terms or your use of the App shall not exceed the amounts you paid us in the 12 months preceding the claim.
Nothing in these terms excludes or limits liability that cannot be excluded under applicable law, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.
11. Termination
You may stop using the App and delete your account at any time via Settings → Delete Account. Account deletion requests removal of your active Nelo account and App content as described in the Privacy Policy. It does not cancel an App Store subscription, which you must manage separately through Apple.
We may suspend or terminate access when reasonably necessary to address a material violation of these terms, protect users or the service, comply with law, or prevent fraud or abuse. Where practicable and lawful, we will provide notice.
12. Changes to These Terms
We may update these Terms of Use as the App or legal requirements change. We will update the "Last updated" date and, when required, provide notice before material changes take effect. Your continued use of the App after the effective date of updated terms constitutes acceptance where permitted by law.
13. Governing Law
These terms are governed by the laws of England and Wales. Any disputes arising from these terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory local consumer protection laws in your country of residence apply.
